Miamisdistributor LLC ("Pulse," "we," "us," or "our") operates the Pulse website, mobile applications, and related services (the "Service"). This Privacy Policy explains what information we collect, how we use it, who we share it with, and the choices you have.
Creating a Pulse account, or using the Service, means you agree to this Privacy Policy as it exists then and as later updated under Section 12. If you do not agree, do not create an account or use the Service. Agreeing to this Privacy Policy (including later updates) is not consent to marketing email.
1. Who This Applies To
The Service is intended for users 18 years of age or older. We don't knowingly collect personal information from anyone under 18. See Section 10 for more on this. Some nightlife events may require 21+ at the door; that is a venue rule, not Pulse account eligibility.
2. Information We Collect
Information you give us directly:
- Account information: name, username/handle, email address, phone number, profile photo, account role (fan, artist, venue, or promoter).
- Content you create: videos, photos, captions, comments, profile bio and links, event listings, booking requests.
- Messages: direct messages and event chat you send through the Service.
- Transactional information: ticket purchases, marketplace listings (where that feature is enabled), booking requests, and payment-related information needed to complete a charge. We do not store your full card number or bank account details ourselves; those are handled directly by our payment processor, Stripe (see Section 5).
- Wristband orders: when you buy a Pulse NFC wristband, we collect order details, shipping name and address, email/phone for delivery updates, colourway/SKU selected, and payment confirmation from Stripe. Pulse is the merchant of record for wristband sales.
- Communications with us: if you contact support, report content, or submit a copyright/removal request.
- Marketing preferences: whether you receive Pulse news, events, and product updates by email, plus the time, source, and policy version tied to that choice.
- Invited accounts that already existed when marketing email launched were subscribed. Those people had already accepted Pulse personally (founder-invited friends), before the current signup clickwrap existed. That is not the same as ticking today's optional marketing box. Corporate Pulse marketing email is not sent under a personal-relationship exception; addresses we associate with Canada, the UK, or the EEA may be held. They can unsubscribe anytime in Settings → Account or via the link in any marketing email. We do not overwrite an existing opt-out.
- New accounts start off for marketing email unless you check the separate optional box at signup (or later opt in in Settings).
- Phone-only synthetic mailboxes (p…@phone.movinpulse.com) never receive marketing.
- Agreeing to the Terms and Privacy Policy, including later updates, does not subscribe a new account to marketing.
Wristbands and NFC identifiers:
- Each Pulse wristband includes a wearable NFC identifier (chip UID / tap ID). When someone taps the band on a compatible phone, that identifier is used to open the linked Pulse profile or claim flow.
- If you claim or link a band to your account, we associate that identifier with your account so taps resolve to you.
- The wristband is a Pulse identifier. It is not a stored-value wallet and does not hold cash, ticket balance, or payment credentials unless we clearly offer and load that feature (we do not currently).
Door scanning and event entry:
- When a venue scans a Pulse QR ticket (or other supported entry credential) at the door, we may log scan events such as ticket ID, event ID, venue, timestamp, scan result (valid/invalid/already used), and the staff account that scanned. These logs help venues run the door and help us prevent fraud and support refunds/disputes.
- We do not collect facial recognition or other biometric templates for door entry.
Information collected automatically:
- Device and technical information: IP address, browser type, operating system, and standard web request information, collected through our hosting provider's normal server logs.
- Approximate location: if you set a city or general area on your profile, or if a venue lists an address. We do not currently collect precise device geolocation.
- Cookies and similar technologies: see Section 3 and our Cookie Policy.
Information we do not currently collect: We do not currently use third-party advertising trackers, analytics pixels, or cross-site tracking technology. If this changes, we'll update this policy and, where required, ask for your consent first.
3. Cookies and Similar Technologies
We use first-party cookies and similar storage (such as session storage) that are needed to operate the Service. For example, keeping you signed in, securing requests, and completing checkout. We do not currently use third-party ad or analytics pixels. More detail is in our Cookie Policy (https://www.movinpulse.com/cookies).
4. How We Use Information
We use the information above to:
- Create and manage your account, and verify account types (e.g., venue or artist verification).
- Operate core features: the video feed, event discovery, ticketing, messaging, artist booking tools, and wristband claim/tap resolution.
- Process transactions, fulfill wristband orders (including shipping), and facilitate payouts.
- Support door scanning, entry validation, and related fraud prevention.
- Respond to support requests, content reports, and copyright/removal notices.
- Maintain the safety and integrity of the Service, including detecting abuse and enforcing our Terms of Service and Acceptable Use Policy.
- Send you transactional communications (ticket confirmations, booking updates, shipping notices, password and invite mail). These are sent so we can run your account and purchases. They are not marketing. Transactional email goes through Resend. One-time security codes go by SMS only when you request them (see Mobile numbers and text messages below). Ticket/booking SMS is not sent unless you separately opt in to Account Notifications.
- If you have a marketing-email preference on file, we may send Pulse news, events, and product updates by email through Loops (Astrodon Corporation). Loops receives contacts only when Pulse has marketing_email_opt_in=true (including the invited cohort described above while they remain opted in). Phone-only synthetic mailboxes (p…@phone.movinpulse.com) are never sent to Loops for marketing. We honor marketing opt-outs the same day when practicable, and in any event within 10 business days (CAN-SPAM outer bound). Unsubscribing from marketing does not stop transactional mail (Resend). Pulse does not send marketing SMS. Optional marketing is email only. Canada / UK / EU: If you use Pulse from Canada, the UK, or the EEA/UK, different electronic-marketing rules may require prior consent or limit "soft opt-in." See Section 11 and contact app@movinpulse.com. Pulse does not currently claim an EU establishment.
- Comply with legal obligations.
We do not use your content or messages to train any AI model, and we do not sell your personal information.
5. Who We Share Information With
We share information with the following categories of service providers, each of which processes it only to provide their specific service to us:

We may also disclose information if required by law, to protect the rights and safety of Pulse or our users, or in connection with a merger, acquisition, or sale of assets (in which case we'll provide notice as required by law).
Mobile numbers and text messages
If you give Pulse a mobile number to sign in or verify that number, we use it to send one-time security codes for that request (Twilio Verify). That is OTP-only. It is not consent to ticket, booking, listing, or other account-notification texts.
Account Notifications SMS (ticket/booking/account transactional texts) is a separate optional campaign. We send those texts only if you opt in to that campaign separately. Creating an account, agreeing to the Terms or this Privacy Policy, requesting an OTP, or buying a ticket does not enroll you. You do not have to join Account Notifications to create an account or to buy tickets.
Message frequency varies. Standard message and data rates may apply. Reply HELP for help or STOP to cancel the program that texted you. Twilio (and Twilio Verify) process those messages as our SMS provider.
We do not share, sell, rent, or provide your mobile phone number, SMS consent, or opt-in data to third parties, affiliates, or lead generators for marketing or promotional purposes. We do not sell opt-in data. Twilio and other processors receive a number only to deliver the message or to run Verify, not to market to you for their own purposes.
Pulse does not send marketing texts. Optional marketing is email only. New accounts are off unless you check the separate email box (or later turn email on in Settings). Phone-only synthetic mailboxes (p…@phone.movinpulse.com) never receive marketing. Agreeing to the Terms or this Privacy Policy, including later updates, is not consent to marketing SMS or to Account Notifications SMS.
6. Data Retention
We retain your information for as long as your account is active, plus a period afterward as needed for legal, tax, dispute-resolution, or security purposes. Order, payout, and door-scan records may be kept longer when required for fraud prevention, accounting, or law. If you delete your account (see Section 9), we delete or de-identify your personal information within a reasonable period, except where we're required to keep certain records.
If you opt out of a text program by replying STOP, we stop campaign texts of that program to that number. We keep the phone number on your Pulse account for account security, fraud prevention, and administration. A later request for a sign-in code may still send one OTP for that request.
7. Data Security
We use reasonable technical and organizational measures to protect your information, including access controls and encryption in transit. No method of transmission or storage is completely secure, and we can't guarantee absolute security.
8. Your Privacy Rights and Choices
Depending on where you live, you may have rights to access, correct, delete, or receive a copy of your personal information, and to opt out of certain uses. Including California "Do Not Sell or Share" requests. We do not sell personal information, and we do not share it for cross-context behavioral advertising. You can still submit a request through:
- In-app: Settings → Privacy (including any "Do Not Sell or Share" control we display there)
- Email: app@movinpulse.com with subject line "Do Not Sell or Share" if you prefer email
We'll respond to verified requests within the time required by applicable law (generally 45 days, with a possible extension).
Marketing communications: If you have a marketing-email preference on file, we may send Pulse news, events, and product updates by email through Loops (Astrodon Corporation). Loops receives contacts only when Pulse has marketing_email_opt_in=true (including the invited cohort described in Section 2 while they remain opted in). Invited accounts that already existed when marketing email launched were subscribed; those people had already accepted Pulse personally (founder-invited friends), before the current signup clickwrap existed. If you receive marketing at an Apple Hide My Email address, unsubscribing still works the same way. Pulse does not send marketing SMS. Optional marketing is email only. Agreeing to the Terms or this Privacy Policy, including later updates, is not consent to marketing email, marketing SMS, or Account Notifications SMS. Canada / UK / EU: If you use Pulse from Canada, the UK, or the EEA/UK, different electronic-marketing rules may require prior consent or limit "soft opt-in." 9. Deleting Your Account
You can delete your account by emailing app@movinpulse.com or through Settings → Privacy where available. This will remove your profile, content, and messages from active use, subject to the retention exceptions described in Section 6. Unlinking a wristband from your account does not by itself delete order or shipping records for past purchases.
10. Children's Privacy
The Service is not directed to anyone under 18, and we don't knowingly collect personal information from anyone under 18. If we learn that we've collected personal information from someone under 18, we'll take steps to delete it. If you believe a user is under 18, please report it to app@movinpulse.com.
11. International Users
Pulse is operated from the United States by Miamisdistributor LLC, 8255 Northwest 64th Street, Miami, FL 33166. We process and store information in the United States. We do not currently claim an establishment in the EEA or the UK.
If you use Pulse from outside the U.S., your information is transferred to and processed in the United States. If EU or UK privacy law applies because we offer the Service to you there or monitor behaviour there, we will handle your information under those rules as well as this Policy.
Optional marketing email is a separate choice (signup Box 2 or Settings). Agreeing to the Terms or this Policy is not marketing consent. You can withdraw marketing email anytime in Settings or via unsubscribe — as easy as opting in.
Until we finish mapping international marketing rules, we may hold marketing email to addresses we reasonably associate with Canada, the UK, or the EEA. Corporate Pulse email is not sent under a "personal relationship" exception. Invited early accounts that receive product email were people who already used Pulse personally — that is not the same as ticking today's marketing box — and Canada/UK/EEA addresses in that group may still be held.
12. Changes to This Policy
We may update this Privacy Policy from time to time. Unless the law requires otherwise, if we make a material change we will notify you (for example in the app or by email) and give you a chance to review it before it takes effect. Updates are not retroactive unless the law requires it. Posting a new version alone, without notice, is not how a material change takes effect.
If you keep using Pulse after an update takes effect, you accept the updated policy. If you do not agree, stop using Pulse and delete your account. A later update does not by itself subscribe you to marketing email. The "Last updated" date above reflects the most recent version.
