Miamisdistributor LLC ("Pulse," "we," "us," or "our") respects the intellectual property rights of others and the safety of people depicted in content on our platform. This policy explains two related but distinct processes: how to report copyright infringement under the DMCA (§§1 to 4, 6 to 7), and how to request removal of non-consensual intimate imagery under the federal TAKE IT DOWN Act (§5). These are different laws with different timelines. Don't use the copyright process for an NCII request or vice versa; use the specific process below for what you're reporting.
1. Our Policy
We will respond to clear notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act ("DMCA") and other applicable copyright law. It is our policy, in appropriate circumstances, to disable or remove access to content reported to infringe a third party's copyright, and to terminate the accounts of repeat infringers.
2. Designated Agent

This agent is registered with the U.S. Copyright Office's DMCA Designated Agent Directory (service provider MIAMISDISTRIBUTOR LLC, registration DMCA-1079322). Notices sent to any other address or contact at Pulse may not be processed in a timely manner or at all.
3. How to File a Takedown Notice
To be effective, your notice must be a written communication that includes substantially the following:
- A physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed (or a representative list if multiple works are covered by one notice).
- Identification of the material claimed to be infringing and information reasonably sufficient to permit us to locate it. A direct URL to the specific video, profile, or listing is the most useful thing you can include.
- Your contact information: address, telephone number, and email address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
Notices that don't include all of the above may not be actionable.
Important: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be liable for damages. Don't submit a notice unless you're sure.
4. Counter-Notification
If you believe material you posted was removed or disabled by mistake or misidentification, you may submit a counter-notification to our Designated Agent containing substantially the following:
- Your physical or electronic signature.
- Identification of the material that was removed and its location before removal.
- A statement, under penalty of perjury, that you have a good faith belief the material was removed as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if outside the U.S., any judicial district in which Pulse may be found), and that you will accept service of process from the person who filed the original notice or their agent.
Upon receipt of a valid counter-notification, we will forward it to the original complaining party. If that party does not notify us within 10 business days that they have filed a court action seeking a restraining order against you, we may restore the material.
5. Non-Consensual Intimate Imagery (NCII) Removal
If you are depicted in an intimate visual image or video on Pulse that was published without your consent. Including AI-generated or altered ("deepfake") depictions. You (or someone authorized to act on your behalf) may request its removal.
How to request removal: Use the in-app "Report" option on the specific content and select "Non-consensual intimate imagery," or email app@movinpulse.com. You do not need a Pulse account to submit this request. To help us locate and verify the content, please include:
- Identification of yourself as the person depicted (or your authorized representative, with a statement of that authorization).
- The specific content and its location on Pulse (a direct link, if you have one, or enough detail for us to locate it).
- A statement that the image or video depicts you and was published without your consent.
- Contact information so we can follow up if needed.
What happens next: Upon receiving a valid request, we will remove the content, along with any identical copies we're able to identify on the Service, within 48 hours, consistent with our obligations under the federal TAKE IT DOWN Act. We may reach out to verify a request that appears incomplete or unclear before acting on it, but valid requests are not conditioned on providing more information than the law requires.
This process is separate from the copyright/DMCA process above. If your concern is that someone posted content you own the copyright to, use Section 3, not this section.
6. Repeat Infringers
Pulse will, in appropriate circumstances and at our discretion, terminate the accounts of users who are determined to be repeat infringers of others' copyrights, and will do the same for accounts found to have knowingly published non-consensual intimate imagery.
7. False Claims
Submitting a false or bad-faith DMCA notice, DMCA counter-notice, or NCII removal request may expose you to legal liability, including for damages, costs, and attorneys' fees.
